Account Creation

To use our service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Security

You must notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account information.

Age Requirements

You must be at least 18 years old to use our service. If you are under 18, you may only use our service with the involvement and consent of a parent or guardian.

API Usage Limits

Your usage is subject to the limits specified in your chosen plan:

• Free Plan: 25 mockups per month
• Plus Plan: 300 mockups per month
• Professional Plan: 1,200 mockups per month
• Enterprise Plan: Unlimited mockups

We count successful mockup generations and attempts that fail due to user setup issues. Don't worry - if our servers have problems or there are technical issues on our end, those won't count against your limit. However, if a mockup fails because the PSD wasn't set up correctly (like missing smart objects or incompatible file formats), that will count toward your usage as it still uses our processing resources.

Prohibited Uses

You may not use our service to:

• Generate content that is illegal, harmful, or violates any applicable laws
• Create mockups containing copyrighted material without proper authorization
• Attempt to reverse engineer, decompile, or disassemble our service
• Use automated systems to access our service beyond your plan limits
• Resell or redistribute our service without written permission
• Upload malicious files or attempt to compromise our systems

Content Guidelines

All uploaded artwork must comply with applicable laws and must not contain offensive, defamatory, or inappropriate content. We reserve the right to refuse service or terminate accounts that violate these guidelines.

Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as specified in our refund policy.

Price Changes

We reserve the right to modify our pricing at any time. Price changes will be communicated to existing customers at least 30 days in advance and will take effect at the next billing cycle.

Failed Payments

If payment fails, we may suspend your account until payment is received. We will attempt to process payment for up to 7 days before suspending service.

Cancellation

You may cancel your subscription at any time through your account dashboard or by contacting support. Cancellation takes effect at the end of your current billing period.

Refund Policy

We offer a 14-day money-back guarantee for new customers. Refunds are processed within 5-10 business days and returned to the original payment method.

No refunds are provided for:

• Partial usage of monthly/annual subscriptions
• Usage-based charges that have been incurred
• Failed mockup attempts due to user error (incorrect PSD setup, smart objects not properly configured, incompatible files, etc.)
• Cancellations after the 14-day guarantee period

Data Retention After Cancellation

Upon cancellation, your account data will be retained for 30 days to allow for reactivation. After this period, all personal data will be permanently deleted in accordance with our privacy policy.

Service Availability

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. We may perform scheduled maintenance with advance notice and emergency maintenance as needed.

Service Disclaimers

Our service is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties regarding the accuracy, reliability, or completeness of results
• Warranties that the service will be uninterrupted or error-free

Limitation of Liability

In no event shall MockupKit be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our service.

Your Content

You retain all rights to your uploaded artwork and generated mockups. By using our service, you grant us a limited license to process your content solely for the purpose of providing our service.

Our Service

MockupKit and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

Template Usage

Mockup templates provided through our service are licensed for commercial use. You may use generated mockups for commercial purposes, but you may not redistribute or resell the templates themselves.

Termination by You

You may terminate your account at any time by canceling your subscription through your account dashboard or by contacting support.

Termination by Us

We may terminate or suspend your account immediately, without prior notice, if you breach these terms or engage in prohibited activities.

Effect of Termination

Upon termination, your right to use the service ceases immediately. We may delete your account and data in accordance with our data retention policy.

Governing Law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of our service will be subject to the exclusive jurisdiction of the courts of England and Wales.

Dispute Resolution

We encourage users to contact us directly to resolve any disputes. If informal resolution is not possible, disputes will be resolved through binding arbitration or in the courts of England and Wales.
